Fed aims for a 6.5% jobless rate




















Six and a half percent unemployment in America would mean almost 2.1 million more people working than today. At the rate the country has been creating new jobs each month, it would take more than a year to find work for that many people.

Keep 6.5 percent in mind this week when the Federal Reserve meets Tuesday and Wednesday to talk about its efforts to push interest rates down. The hope is that the cheap cash will spur on investment leading to job creation. After all, the central bank has promised to keep its target interest rate near zero as long as more than 6.5 percent of Americans in the workforce are without work. The Fed has put other conditions on maintaining its historically low interest rate such as low inflation, but official measures remain tame. So its job growth the Fed is looking for.

It won’t have to wait long for the latest update. On Friday the first jobs report of 2013 will be released. Hiring has been a slow grind but it has been positive.





Finding work in January, though, can be tricky. Winter weather, a hangover from the holidays and seasonal work ending can slow down hiring.

It will be months, maybe even a couple of years before the U.S. unemployment rate hits 6.5 percent. There is nothing magical about that number, but as long as the Federal Reserve has it in its sights, so should we.

The missing Miramar mom: a tale of love, jealousy, mystery




















It was Feb. 24, girls’ night out. Best friends Vilet Torrez and Clarissa Garcia went out to the Cheesecake Factory, where they ordered drinks and split a slice of cheesecake.

They laughed and chatted and caught up on the things best friends talk about over drinks and desserts: their families, their children, their marriages.

And, yet again, Garcia advised her friend she had to leave her husband.





She was tired of hearing the stories of how Cid Torrez beat her and then swore every time afterward he would never do it again. She was sick of seeing Vilet with bruises.

“What’s it gonna take? Your death? A casket?” Garcia asked.

“Oh, my good friend, he wouldn’t do that,” Torrez said.

Torrez went missing five weeks later.

Friends, family and former co-workers of Torrez all believe her husband, Cid, is behind her disappearance. Miramar police and prosecutors agreed and — despite the lack of a body, or an eyewitness, or a weapon — charged the 39-year-old with murder. Such murder charges don’t always stick, as evidenced by the just-completed murder trial of Geralyn Wilson, foster mother of Rilya Wilson. It was another case of no body, no witnesses, no murder weapon. Geralyn Wilson was convicted of lesser charges.

Cid’s family expressed disbelief that he would harm, much less kill and dispose of, the mother of his three children, although they acknowledged the marriage had turned toxic.

Cid Torrez has pleaded not guilty and awaits trial in a Broward jail.

A NEW COUNTRY

Vilet’s disappearance — and presumed death — brought a sudden and nightmarish end to a life that, from the outside, looked like a South Florida variation of the American dream, the kind of success story that reaffirms the belief that anybody with enough determination can flourish in the United States.

Born Vilet Blanco, she came with her family from Nicaragua to Hialeah when she was 15. None of them spoke English. Vilet learned the language at warp speed and excelled enough at Miami Springs Senior High School to get several college scholarships.

Vilet and Cid, also from Nicaragua, started going out during her junior year of high school and never stopped, except for a brief college breakup.

From that point on, Vilet’s world was Cid.

THE MOTHER

Vilet Torrez graduated from the University of Miami in 1997, with a major in advertising, got a job and, a year later, married Cid — on Aug. 8, 1998. It was a small ceremony in Hialeah. The honeymoon was quick, since Cid was being deployed in a matter of days for a tour that would take him to Japan, Guam, Indonesia and Australia.

Weeks later, Vilet learned she was pregnant.

When Cid came back to the United States, he was sent to North Carolina, joined by his wife and their first-born, a daughter also named Vilet.

In about a year, Cid had left the Marines and they were back in South Florida, living in the Blanco family home in Hialeah.

They fought frequently, Vilet’s family recalled, and Cid sometimes ended up sleeping in the car. But Vilet had seen her parents separation when she was a child and was determined not to do the same.

“I am not going to let him go like you did with my dad,” Vilet told her mother, Gladys Blanco.

THE COWORKER

Upon the family’s return, the boyfriend of Vilet’s sister Nayiva helped Vilet get a job where he had worked. Soon he started telling Nayiva stories he was hearing from former coworkers about how Cid would show up at work, unannounced, just checking in on his wife.

If you want to share your Vine on Tumblr, one of the easiest ways is to just upload it directly to your Tumblr from your iOS device using Tumblr’s app.

5. Leo DiCaprio Taking a 'Long Break' From Acting

Unless something was lost in translation, Leonardo DiCaprio has revealed to a German publication that he will be taking a hiatus from acting.

The 38-year-old A-lister told Germany's daily Bild (via Deadline), "I am a bit drained. I'm now going to take a long, long break. I've done three films in two years and I'm just worn out."

DiCaprio's Django Unchained just came out this past month and he also has The Great Gatsby hitting theaters this year (May 10th) as well as The Wolf of Wall Street. So, what does DiCaprio plan to do with his free time? "I would like to improve the world a bit. I will fly around the world doing good for the environment."

The actor added, "My roof is covered with solar panels. My car is electric. A normal person does not drive more than 50 kilometers (31 miles) a day. That can be done with a plug."

Bloomberg giving $350 million to alma mater John Hopkins; he's first to donate more than $1B to single US university








Mayor Michael Bloomberg is giving $350 million to alma mater Johns Hopkins University, pushing his lifetime giving to the private Baltimore university past $1 billion, the university said today.

University officials believe Bloomberg, who earned his fortune creating the global financial services firm Bloomberg LP, is now the first person to give more than $1 billion to a single U.S. university.

Most of the latest gift, $250 million, will go toward a variety of cross-disciplinary subjects, including research on water resources, health care, global health, the science of learning and urban revitalization.

The remaining $100 million will go to need-based financial aid for undergraduate students, awarding 2,600 Bloomberg scholarships in the next 10 years.

"Johns Hopkins University has been an important part of my life since I first set foot on campus more than five decades ago," Bloomberg said in a statement released by the university. "Each dollar I have given has been well-spent improving the institution and, just as importantly, making its education available to students who might otherwise not be able to afford it."

The mayor has stayed closely involved with the university where he graduated in 1964, including stints on its board of trustees from 1996 to 2002 and as chairman of Johns Hopkins Initiative fundraising campaign. Among his past gifts was $120 million toward the construction of a children's section at The John Hopkins Hospital in honor of his late mother.

"This latest initiative allows us to greatly accelerate our investment in talented people and bring them together in a highly creative and dynamic atmosphere," university president Ronald J. Daniels said in a statement. "It illustrates Mike's passion for fixing big problems quickly and efficiently."

Appeals court again upholds power of Miami’s Civilian Investigative Panel




















An appeals court has struck down a police officer’s challenge to the validity of Miami’s Civilian Investigative Panel — the second time the panel has withstood a legal challenge from police officers in the past five years.

Police Lt. Freddy D’Agastino and the Fraternal Order of Police filed a lawsuit arguing that the civilian panel, which reviews citizen complaints against officers and makes recommendations to the police chief, had no legal authority to investigate officers.

But in a ruling on Wednesday, the Third District Court of Appeal found that the panel neither conflicts with state or local law, nor intrudes on the police department’s power to discipline its officers. The CIP does not have the authority to discipline officers, though it does have the power to subpoena records and witnesses in its own investigations.





The appeals court also upheld the panel’s authority in 2008, when then-Police Chief John Timoney sought to prevent the panel from investigating him.

Spanish newspaper sorry for “false photo” of Venezuela’s Chavez






MADRID/CARACAS (Reuters) – Spain‘s influential El Pais newspaper apologized on Thursday for splashing a “false photo” of Venezuela‘s cancer-stricken leader Hugo Chavez on its front page, prompting a furious response from the government in Caracas, which vowed to take legal action.


Within minutes of posting the image online as a global exclusive, El Pais said it had discovered from social media that the photo was not of Chavez. It removed it from its website and withdrew its print edition.






Venezuela’s government said the publication of the photo – which showed the head of a man lying down with a breathing tube in his mouth – was “grotesque,” while Argentinian President Cristina Fernandez, a close ally of Chavez, called it vile.


“El Pais apologizes to its readers for the damage caused. The newspaper has opened an investigation to determine the circumstances of what happened and the errors that were committed in the verification of the photo,” the paper said.


Chavez, 58, is fighting to recover in Cuba after undergoing his fourth cancer operation in just 18 months. He has not spoken or appeared in public for six weeks, fuelling speculation about how serious his condition is.


El Pais, one of the world’s biggest Spanish-language publications and an institution both in Spain and in Latin America, said it received the grainy image from the agency Gtres Online, which it said represents 60 other agencies in Spain.


In a statement, El Pais said the newspaper was told it had been taken seven days earlier by a Cuban nurse who was part of Chavez’s medical team, and was then sent to the nurse’s sister, who lives in Spain.


“The agency has acknowledged it was deceived by those who provided the material and will take legal action,” El Pais said.


The photo was on the newspaper’s website for half an hour and also appeared in early editions of the print version that were then pulled from newsstands and replaced with a new edition with a different front page.


In Venezuela, anxious Chavez supporters and opponents alike are waiting for any new picture, video or audio message from the socialist leader, who is famed for filling the airwaves with long-winded speeches, jokes and withering jabs at his foes.


NO SIGHT OF CHAVEZ


Officials say his condition is improving after he suffered multiple complications, including unexpected bleeding and a severe respiratory problem following the December 11 surgery.


But, in contrast to Chavez’s previous visits to Havana, officials have not published any evidence of his condition. In 2011, with great fanfare, they broadcast video footage of him reading a newspaper, walking in a garden, and chatting with his friend and mentor, Cuba’s ex-leader Fidel Castro.


In the absence of such proof this time, many Venezuelans are questioning the terse official bulletins and suspect Chavez’s extraordinary 14 years in power could be coming to an end.


The president has never said exactly what type of cancer he has, only that the initial tumor found in mid-2011 was in his pelvic area and was the size of a baseball.


Venezuelan opposition leaders have long accused the government of secrecy over his illness, while supporters accuse “bourgeois” local and foreign media of being in league with the opposition to spread rumors he is at death’s door.


The handling of information relating to Chavez’s health has become as contentious as the man himself, and his administration’s updates have been confusing and contradictory.


The government says it has never been more transparent. It described El Pais’s publication of the picture – a screengrab from an unrelated 2008 video – as part of efforts by far-right political forces to attack Chavez’s self-styled revolution.


It said it would take appropriate legal action, and that the newspaper’s apology to its readers was not enough.


“Neither their disgusting photos nor their systematic campaigns will stop the president’s advance,” Information Minister Ernesto Villegas told a news conference in Caracas.


“Would El Pais publish a similar photo of a European leader? Of its director? Sensationalism is valid if the victim is a revolutionary ‘sudaca’,” he added, using a pejorative term that is sometimes used in Spain to refer to Latin Americans.

Nicolas Cage Superman Lives Kickstarter Documentary

Director Zack Snyder and producer Christopher Nolan are putting the finishing touches on their big-budget Superman reboot, Man of Steel, which flies into theaters this June. As buzz around the return of the Son of Krypton continues to grow with Henry Cavill in the title role, many non-film geeks may be unaware that in the late '90s there was a major Superman film in the works that never got off the ground – with a first draft script written by Kevin Smith, directed by Tim Burton, and starring Nicolas Cage as the man in the red cape. Yep, you heard that right.

Metalocalypse director and Grimm Fairy Tales producer Jon Schnepp is a man obsessed with this film that never got made -- just before Superman Lives was set to start filming in 1997, production was shut down on – and now he's attempting the second-best thing to seeing the final film: He's putting together a documentary chronicling the movie that never was with the help of Kickstarter called The Death of Superman Lives; What Happened?

"For whatever reasons, it all fell apart right before they started shooting," says Schnepp. "It's a bummer, I mean, especially looking at it like almost 15 years later, we could've had the weirdest Superman movie ever made. The weirdness level of this Superman movie beats any superhero film that's ever been made."

After the huge, successful re-launch of the Batman franchise in the early '90s with Michael Keaton in the title role, Warner Bros. was keen to get Burton on board to resurrect their Superman franchise, which had lost steam after four Christopher Reeve movies (WB was only loosely associated with 1987's Superman IV: The Quest for Peace) a decade before. Much like how they recently got The Dark Knight trilogy producer Christopher Nolan on board to produce Snyder's Man of Steel, WB execs believed Burton had the magic touch.

But Burton's vision was perhaps a little too eccentric for the very "Boy Scout" Superman franchise, envisioning bizarre black, rainbow-colored and electrical circuitry suits; drooling, scaly monsters; skull-shaped spaceships; and a Superman who didn't even fly. Brainiac was intended to be the main villain, with a disembodied head connected to a spidery robotic apparatus, no doubt the influence of former Batman and Batman Returns producer Jon Peters, who was obsessed with spiders.

Of course, we all know that Warner Bros. eventually entrusted the Superman franchise to X-Men director Bryan Singer, whose Superman Returns fell short of box-office expectations in 2006 and failed to yield a new series. Meanwhile, Nic Cage named his own son after Superman, with little Kal-El born in 2005, and Burton went on to make a string of remakes and franchise adaptations to varying degrees of success -- but never took on another major comic book superhero.

The enthusiastic Schnepp is hoping to interview the key artists involved with the Superman Lives movie that never happened, and if his Kickstarter campaign exceeds his budget goal, he plans to use the money to film a few actual scenes from the film that never saw a frame of exposed celluloid. Pretty cool idea, eh?

Caught: Suspect who escaped during bathroom break nabbed in Bronx








They finally flushed out this fugitive!

A murder suspect who escaped from a Brooklyn police precinct yesterday by asking a cop for a bathroom break was captured today by cops hiding out in a friend’s Bronx apartment, the NYPD said.

Brandon Santana, 24, was apprehended at 3:15 p.m. at 3930 Third Avenue by NYPD officers and the Regional Fugitive Task Force, about 37 hours after he ran, un-handcuffed, from the 78th Precinct in Park Slope after knocking down a cop escorting him to the toilet.

Police said that the girlfriend of Santana’s friend opened the door when they arrived, and she told them that a pal of her boyfriend was staying there.

Cops found Santana standing in the bedroom, and took him into custody without incident, according to the NYPD.

Santana is suspected of repeatedly bashing 22-year-old dad-to-be Alexander Santiago with a lead pipe during a gang assault on the man and three of his friends at 12th Street and Fifth Avenue in Park Slope on Aug. 1, 2010.

After Santana’s latest arrest today, Santiago’s girlfriend Stephanie Mercado, told The Post, “'I hope the cops keep him tight, and don't let him get away.”

“No bathroom breaks this time,” Mercado said. “And now that they have him we want them to get the rest of the cowards. I want justice."

Santana’s apprehension was the second time in the past week he was caught by cops.

He had been hiding out with a relative in Iowa, but returned to the city this week – and was promptly caught by cops who wanted to arrest him for Santiago’s murder.

Detectives questioned Santana at the station house Wednesday night, and then left at the end of their shift at 1 a.m. yesterday, expecting to put him in a witness lineup later.

An hour later, after he had been placed in a first-floor holding cell, Santana asked the officer minding him if he could use the bathroom.

When the cop opened the cell door, Santana — who was not handcuffed — shoved the officer, knocking him to the ground, and ran straight out of the station house, law-enforcement sources said.

One cop behind the front desk jumped over it to chase him, but hurt himself in the process, sources said.

A lieutenant also went after Santana but couldn’t catch up, sources said.

“It’s like they gave us justice, then took it away,” said Anaisa Santiago, Alexander’s 15-year-old sister yesterday.

Cinelatino and WAPA part of new company




















A private equity firm hopes Wall Street will be simpatico with some leading Spanish-language media companies.

InterMedia Partners has transferred three of its Latin media holdings into a placeholder of a publicly traded company called Azteca Acquisition Corp. The move of Cinelatino, WAPA America and WAPA TV gives investors quick access to Wall Street and the ability to trade sell shares in the new company. The deal is valued at $400 million, and InterMedia will remain the primary owner of the new company, according to a release.

The company will be called Hemisphere Media Group and will have corporate headquarters in the Miami area. The merger of the Spanish-language cable movie network (Cinelatino), Spanish-language cable network targeting the U.S. Puerto Rican market (WAPA America), and the Puerto Rico broadcast network (WAPA TV) will not affect operations at the three businesses, a spokesman said.





Hemisphere will apply to be traded on the NASDAQ stock exchange. Alan Sokol, a senior InterMedia partner and former COO of Telemundo, will be CEO of the new company.

Miami Dolphins assemble familiar faces for lobbying team, many with ties to Mayor Carlos Gimenez




















The Miami Dolphins’ lobbying team looks like a reunion of Miami-Dade Mayor Carlos Gimenez’s campaign brain trust.

To push for a $400-million stadium renovation funded in part with tax dollars, the Dolphins have enlisted three key figures from Gimenez’s recent election races: Marcelo Llorente, Brian Goldmeier and Jesse Manzano-Plaza.

Llorente, who became a frequent presence on the campaign trail after losing his own mayoral bid, has been hired as one of the Dolphins’ Tallahassee lobbyists. Goldmeier, Gimenez’s fundraiser, and Manzano-Plaza, a former Gimenez campaign manager, have been brought on as advisers to help drum up community support for the Dolphins’ plan.





The three men’s participation could indicate a calculated effort on the Dolphins’ part to appeal to the mayor, whom Miami-Dade commissioners tasked on Wednesday with negotiating a potential deal with the football team. Gimenez was a stubborn critic of the lopsided public financing deal for the new Miami Marlins ballpark in Little Havana — a position that helped the former commissioner in his campaign for mayor.

Gimenez dismissed the suggestion that a particular lobbying or campaign team could curry favor with his office.

“If anybody knows me, you can hire whoever you want. At the end of the day, I work for the people of Miami-Dade County — that’s who pays my salary,” he said in an interview Thursday. “I’m pretty black-and-white about things like that.”

Gimenez, who said he was unaware of Llorente’s and Manzano-Plaza’s involvement with the Dolphins, said his former election workers are successful in their own right.

“They’re very good at what they do, and they’re professionals,” he said. “I would hope that’s why the Dolphins hired them. In terms of me, that makes no difference.”

Goldmeier, Llorente and Manzano-Plaza are part of a larger team, led by Dolphins CEO Mike Dee, hunting for votes among state lawmakers and county commissioners, who would have to sign off on the football team’s request to raise a Miami-Dade mainland hotel tax to 7 percent from 6 percent and to receive a $3 million annual subsidy from the state. The funds would amount to some $199 million, about half the cost of proposed upgrades to Sun Life Stadium in Miami Gardens.

Voting 9-4, commissioners on Wednesday endorsed state legislation that would allow the county to raise the hotel tax — an early victory for the Dolphins, who are having to stare down criticism of the Marlins deal. Commissioners directed Gimenez to negotiate with the Dolphins. The mayor said talks would begin soon, led on the county side by deputy mayors Ed Marquez and Jack Osterholt.

“If the public is going to be investing money via a bed tax — which is tourist money, but still public money — then what are we going to be getting in return? Why should we be investing public money into the enterprise?” Gimenez said. “I know we’re not going to put the general fund at risk in any way, shape or form. There’s not going to be any fancy financing.”

His administration will likely hire outside consultants with expertise in negotiating with professional sports teams, the mayor added.

“I don’t want to be at a disadvantage,” he said. “So it may be that we come to some kind of framework — and maybe we don’t.”

Nintendo Reaches into Wii U Grab Bag, Pulls Out Some Vague, Some Fascinating Promises






It’s been a ho-hum 2013 for Nintendo’s Wii U so far: some carry-over posturing about scads of “launch window” titles, but less than a handful of games with bankable release dates. When I checked the hopper for January, February and March, I counted four, maybe five Wii U titles with firm dates, all of them least a month or two off.


That’s not how you move systems, and Nintendo ran damage control Wednesday morning by trotting out company president Satoru Iwata in a broad-ranging (and reaching) “Wii U Direct” video effort to soothe jittery system owners and would-be buyers still waiting for slam dunks. Call it Nintendo circling its wagons…or maybe just an “if you squint you can make it out on the horizon” wagon-train parade.

“In past Nintendo dialogues, we have focused more on games releasing in the near future, but it’s still early in 2013, so I’d like to change the format a little bit,” said Iwata before launching into a sneak preview of what Nintendo has cooking.


For starters, Iwata says the Wii U will see at least two major system updates this year: one in the spring, another during the summer. Arguably the most important of these involves a desperately needed fix for the crazy-long time it takes to launch apps or reload the Wii U Menu — a process that can take up to 30 seconds. Imagine if each time you backed out of an iOS app it took half a minute to bring up iOS’s icon overlay. That’d be insane, and it’s a shame quality control didn’t view load times as prohibitive enough to remedy before the launch in November. Thank goodness Nintendo’s working to put things right.


Iwata also mentioned finally debuting the long-awaited Wii U Virtual Console – Nintendo’s vehicle to sell old-school NES and Super NES games – just after the spring system update. The Virtual Console’s been missing in action since the Wii U launched, despite its longstanding availability on the original Wii. That, according to Iwata, is because Wii U Virtual Console games are poised to offer features their Wii counterparts didn’t, like being able to save backups of your game progress, the option to play away from the TV on the Wii U GamePad, access to Miiverse communities for these older games and support for additional platforms like the Game Boy Advance (never released on the Wii Virtual Console).


If you’ve already purchased the Wii Virtual Console version of a game, it sounds like you’ll have to pay again, though Nintendo says you’ll get “special pricing”: regularly priced games will run $ 5 to $ 6 (NES) or $ 8 to $ 9 (SNES), with those prices dropping to $ 1 and $ 1.50, respectively, if you bought the game for Wii Virtual Console. It’s better than no discount, I suppose, and Nintendo can probably justify the nominal buck to buck-and-a-half for research and development on the Wii U Virtual Console’s extras (it’s certainly taking the company long enough to pull everything together).


If you’d rather not wait for spring, Nintendo’s running a beta dubbed “Wii U Virtual Console Trial Campaign”: Between January and July, Nintendo will release a classic title every 30 days for $ 0.30 a pop (Nintendo’s tied the pricing and release timeframes in with the original Famicom‘s 30th anniversary in Japan, coming up this July). After July, the prices of the discounted titles will bounce back to normal, but you’ll be able to buy them at the reduced price if you participated in the beta. The games list is none too shabby, either: Balloon Fight, F-Zero, Punch-Out!!, Kirby’s Adventure, Super Metroid, Yoshi and Donkey Kong.


Wii U Virtual Console sounds like a clever little diversion for Nintendo wonks, but let’s not forget how fuzzy these games look nowadays on resolution-locked flat-screens. It’s not that I want high-res versions — these things are what they are at their native pixel counts — but you wouldn’t lay wax paper over a Monet, would you?

Let’s cut to the chase: Nintendo fans want to know where the next Zelda game is, what comes after Super Mario Galaxy 2, when they’ll be able to sample the Wii U’s take on Mario Kart, what’s up with the next Super Smash Bros. game and so forth.


Iwata confirmed that Nintendo won’t offer new games in January or February and apologized for this, but said “Nintendo takes seriously its responsibility to offer a steady stream of new titles in the very early days of a new platform to establish a good lineup of software.” Why the delay? Because, says Iwata, “We firmly believe we have to offer quality experiences when we release new titles.” No argument there.


What’s coming between spring and summer? Iwata identified several titles: Game & Wario, Wii Fit U, Pikmin 3, LEGO City Undercover and The Wonderful 101. But don’t get too excited: These were originally slated to hit by March.


We also caught another glimpse of Bayonetta 2 (as well as the female protagonist’s backside), heard a bit about Super Smash Bros. U and why it’ll probably be a while before we see it (screens at E3), and then Iwata talked about, well, a bunch of stuff we already knew was in the offing: a new unnamed Super Mario game by the team that developed the Super Mario Galaxy and Super Mario 3D Land platformers, a new Mario Kart racer (both set to be playable at E3) and a new Wii Party game (Iwata showed video of someone shaking a Wii U GamePad to roll dice as well as two players using a GamePad like a mini-foosball table).


More intriguing were the two unannounced new games, like one from the developers behind Kirby’s Epic Yarn starring Yoshi (a kind of sequel to Yoshi’s Story for the Nintendo 64) or — wait for it JRPG wonks — a Shin Megami Tensei / Fire Emblem crossover from Atlus.


Last but not least, Iwata revealed the company’s plans for Zelda on the Wii U. The really good news: Nintendo says it’s planning to “rethink the conventions of Zelda,” tinkering with tenets like dungeon linearity and solo play. The merely good news: Nintendo’s remastering Zelda: The Wind Waker in HD for the system and tweaking the gameplay. The bad-good news: You’ll probably have to wait a long time for the new Zelda, but you’ll get The Wind Waker HD by “this fall.”


But the best news of all, from where I’m sitting: Taking a page from Apple, Iwata closed by invoking “one more important topic”: a new Wii U game from Monolith Soft, the company responsible for Xenoblade Chronicles, the best roleplaying game on any game system released in…well, when was Final Fantasy XII released? Has it been seven years already?


All told, a mixed performance from Nintendo, but here’s the thing: However vague much of the information in Iwata’s presentation was, I love the dignified, spare, wonderfully thorough way Nintendo’s chosen to address its audience lately. By contrast, I feel like a need to shower after watching most Microsoft/Sony pressers.

Bronx detectives snare 14 in gun sales investigation










These Bronx detectives don’t have supernatural powers — but two operations, including one called Ghostbusters, took down fourteen people in a gun sales investigation today, authorities said.

Ringleader Reinaldo Romero, 27, who gave the operation its name because of his alias ‘Caspa,’ and other crooks affiliated with him allegedly sold 55 guns to undercovers—including seven assault rifles, police said.

Romero sold the weapons out of a Soundview barbershop he owned called Kache on Westchester Avenue, as well as out of his Van Nest home, to cops between April 2011 and November last year.




Most were loaded, and the assault rifles came with 30-round magazines. Some were brand-new, others were used. They were sold in the South Bronx, Soundview, and Baychester, authorities said.

The guns initially came from Ohio, but started coming in from Baltimore last year. “These guns are coming out of state,” said Detective Charles Lennon, the lead investigator on the case. The case started when police received a tip about the gun ring in Brooklyn.

The assault rifles sold for $1400 a pop, while pistols went for $900, cops said.

“They would have gone into the streets of the Bronx," said Lennon.

Romero was charged with first-degree sale of a firearm, authorities said.

Angel Plass, 31, who went by the alias ‘Acura’ was extradited from East Lake, Ohio and arrested Tuesday, police said. He was charged with criminal sale of a firearm, in the third degree.

Elvis Montero, 25, was also extradited from Baltimore, and charged with criminal sale of a firearm, in the third-degree.

Four other people were arrested in a second investigation where they sold 85 guns from George and Virginia to an undercover detective.

“We appreciate the hard work of the NYPD in apprehending these alleged peddlers of illegal and often deadly weapons,” said Bronx District Attorney Robert T. Johnson.

Miami Dolphins slam Norman Braman, Marlins Park deal




















The Miami Dolphins ramped up their public campaign for a tax-funded stadium renovation this week, buying full-page ads against their top critic and trying to distance the plan from the unpopular Marlins deal.

The team bought an ad in Tuesday’s Miami Herald and El Nuevo Herald knocking auto magnate Norman Braman’s criticism of the Sun Life Stadium deal, which would have Florida and Miami-Dade split the costs with owner Stephen Ross for a $400 million renovation. The Dolphins would pay at least $201 million, with taxpayers using state funds and a higher Miami-Dade hotel tax to pay $199 million.

In a fact sheet sent to media Tuesday morning, the Dolphins listed ways their deal differs from the 2009 Marlins deal. First: Ross, a billionaire real estate developer, would use private dollars to fund at least 51 percent of the Sun Life effort, compared to less than 25 percent from Marlins owner Jeff Loria. Second, Sun Life helps the economy more than the Marlins park does.





“Just because the Marlins did a bad deal doesn’t mean we should oppose a good deal where at least a majority of the cost is paid from private sources and more than 4,000 local jobs are created during construction alone,” the fact sheet states. And while the Dolphins’ Miami Gardens stadium has hosted two Super Bowls since 2007 and is in the running for the 2016 game, “Marlins Stadium does not generate the ability to attract world-class sports events -- other than a World Series from time to time depending on the success of the team.”

NFL teams play eight home games a year if they don’t make the playoffs, while baseball teams have 81.

Miami and Miami-Dade built the Marlins a $640 million stadium at the site of the Dolphins’ old home at the Orange Bowl in Little Havana. The Marlins contributed about $120 million and agreed to pay between $2.5 million and $4.9 million a year for 35 years to pay back $35 million of debt the county borrowed for the stadium. As a publicly owned stadium, the Marlins ballpark pays no property taxes. Most of the public money came from Miami-Dade hotel taxes, along with $50 million of debt tied to the county’s general fund.

Sun Life is privately owned and pays $3 million a year in property taxes to Miami-Dade. It currently receives $2 million a year from Florida’ s stadium program, a subsidy tied to converting the football venue to baseball in the 1990s when the Marlins played there. The Dolphins also paid for a second full-page ad with quotes from leading hoteliers in Miami-Dade endorsing the stadium plan. Among them: Donald Trump, whose company recently purchased the Doral golf resort. “Steve Ross’ commitment to modernize Sun Life Stadium -- while covering most of the construction costs -- is the right thing for Miami-Dade,’’ the ad quotes Trump as saying.

Also on Tuesday, Ross and team CEO Mike Dee sent a letter to Miami-Dade Mayor Carlos Gimenez and county commissioners requesting negotiations over the stadium deal. The letter said the deal Ross unveiled last week is a “baseline for debate” and asked for talks. The letter also urged the commission to adopt a resolution proposed by Commissioner Barbara Jordan endorsing the state bill that would allow taxes for Sun Life. The resolution is on the agenda for Wednesday’s commission meeting.

Miami conclave to help map the next 50 years for Southeast Florida




















On a Google map, the long stretch of Florida coastline from deep South Miami-Dade County to Sebastian Inlet appears a seamless mass of urban development jammed between a thin border of sand on one side and wetlands and farmland on the other.

But zoom in and it’s soon sliced up by lines both real and imaginary: roadways, highways, railways, waterways and the boundaries of numerous, and often overlapping, governmental jurisdictions.

Now this vast area, at once connected and disconnected, is the subject of one of the most ambitious planning efforts ever undertaken in Florida. Called Seven50, it aims to chart a coordinated, integrated future for the development of Southeast Florida’s seven counties for a couple of generations, through the year 2060.





On Thursday, the big moveable feast of thinkers, planners, economists, government officials and business leaders that is Seven50 will convene in downtown Miami for the effort’s second public summit since its launch in Delray Beach last June.

It may sound like “wonky stuff,’’ said Seven50 lead consultant Victor Dover, a Coral Gables-based planner. But he said Seven50’s scores of participants are convinced that agreeing to coordinated plans across jurisdictional lines is critical if the region is to prosper and meet a long list of common challenges. They range from transportation logjams to the prospect of rising seas and U.S. and international competitors trying to grab our share of international investment, tourism, cargo and trade.

And that competition is serious and well-organized, Dover said. In Texas, for instance, 13 counties and 100 cities between Houston and Galveston have banded together in a similar planning alliance, and so have cities and states along the Great Lakes.

The advantage Southeast Florida has, Seven50 planners say, is that old real-estate cliche: Location, location, location.

But it risks throwing its advantage away unless it better links up its airports and seaports, installs more and better-connected mass transit, and develops strategies to improve education and retain and attract the kind of skilled, educated young people considered key to economic prosperity in today’s economy.

“Planning at this scale is profoundly American, from Jefferson to the creation of Washington, D.C., and if we don’t do it, we’re going to get blown away by the competition,’’ said Andres Duany, a renown Miami-based planner who will give the keynote address at the downtown gathering. “They’re gunning for us.’’

The free, full day of sessions at Miami Dade College’s Wolfson campus is designed to gather public input and share a still-in-development snapshot of the region as planners build what they describe as a massive data warehouse covering everything from demographics to housing, economics and transportation networks. Key discussion areas will be transportation, education and the daunting implications of climate change.

Because Southeast Florida will be among the first regions to experience rising sea levels, across-the-board planning on how to adapt will be essential. That could include difficult options like steering investment for new public infrastructure away from vulnerable areas, or protecting the region’s underground water supply from saltwater intrusion by raising freshwater levels in drainage canals, which could produce more seasonal flooding in some areas.

Some 200 public agencies, advocates, business groups and academic institutions, including the region’s principal universities, have signed up for the effort. Any resulting plans are purely voluntary, and no town or agency is obligated to adopt any ideas it doesn’t like, planners stress.

Still, the process hit a roadblock in the northernmost county, Indian River. The county commission and the Vero Beach city council voted to drop out after Tea Party-linked activists raised a public ruckus over their participation. The activists contend Seven50 is part of Agenda 21, a 20-year-old, nonbinding United Nations resolution that called for environmentally sustainable urban development, which they describe as a conspiracy to evict people from their homes and force them into dense urban housing.

Seven50 planners had to post a response on their website explaining they intend no such thing. Since then, the Stuart city council voted to join Seven50. Other Indian River agencies remain as participants.

The two-year planning effort, led by a consortium established by the South Florida Regional Planning Council and the Treasure Coast Regional Planning Council, is funded by a $4.25 million grant from the U.S. Department of Housing and Urban Development.

The federal agency is encouraging local governments to engage in long-range planning under the sustainability label, which covers a range of strategies to foster development of pedestrian-friendly urban zones that put jobs close to homes and save energy by providing alternatives to auto transportation.

The multi-city engagement kicks off at Shakespeare Theatre Company in Washington, DC and travels to Detroit, Chicago, Charlotte, Atlanta, Miami, Schenectady, Memphis, Dallas, Cleveland and Los Angeles.

Mother & daughter victim of peeping Tom at H&M -- and employees let him get away, lawsuit claims








A Manhattan boutique owner and her daughter say they got more than they bargained for when they used an H&M dressing room to try on lingerie — they were videotaped by a camera-wielding perv who store employees let get away, a new lawsuit claims.

Zia Ziprin, 51, of the Lower East Side haven Girls Love Shoes and daughter Aishling Labat, 23, were shopping at the discount fashion giant’s Fifth Avenue Flatiron store in January 2010.

The women were “in a state of undress within the dressing room stall” on the second floor when the unidentified man in an adjoining stall filmed them “with a camera or video camera,” according to the suit, filed in Manhattan Supreme Court.

As Labat was changing into the negligee, “She saw there was something above the dressing room. She thought it was a security camera, but when she reached up there was nothing there,” her attorney, Ross Rothenberg told The Post. “She started screaming and he ran from the second story down to the first” and escaped, the lawyer said.

“Their assumption is that somewhere on the Internet is videos of both of them,” semi-naked, Rothenberg said, adding that they haven’t been able to track down the smut.

Both Ziprin and Labat “pleaded with H&M’s security and store personnel to stop [the man] from leaving the store ...with the compromising video and photographs,” the suit says. Ziprin, a curvy blonde, “begged for help from security and/or store personnel, who ignored her request.”

Rothenberg said police obtained security footage of the creep and investigated the incident but never caught him.

The women want unspecified damages for the “embarrassment, humiliation, fear, panic, torment” they suffered, the suit says.

The suit charges the store with building flimsy, unisex dressing rooms that allow easy accesses to eavesdroppers and peeping toms.

An H&M spokeswoman said the company hasn’t seen the suit, but its policy is to decline comment on legal matters.

Recalled Mayor Carlos Alvarez wins — in bodybuilding contest




















Former Miami-Dade Mayor Carlos Alvarez is back, in rare form, displaying bulging muscles from his pecs to his calves, bronzed from head to toe, dressed in the skimpiest of black briefs.

After almost two years of seclusion, Alvarez reemerged in November Hulk-like, taking home first prize in the National Physique Committee’s South Florida “Over 60s” Master’s bodybuilding competition at Miami’s James L. Knight Center.

Event promoter Sergio Pacheco said Alvarez’s victory over five other men qualified him for the more prestigious Junior National Master’s competition.





Pacheco, who owns Pacheco’s Physique Gym in Hialeah, said he had heard the former mayor competed in an event a few weeks earlier in West Palm Beach, but had no idea he had entered the Knight Center contest.

“When I saw him walk in, I said, ‘Wow, I know him,’ ” Pacheco said.

The former mayor and county police director was recalled from office in March 2011 by 88 percent of the electorate, after constituents had a hard time wrestling with a series of raises he awarded his inner circle and with his backing of the new, $634 million Miami Marlins ballpark in Little Havana.

Since the recall, Alvarez, 60, has rarely been seen in public. He has been spotted spending lots of time at a tony gym at Merrick Park in Coral Gables. Deanna Clevesy, a spokeswoman for Equinox Gym Coral Gables, confirmed Tuesday that Alvarez works out there, but refused to share details on his regimen.

Spotted on the field before the Marlins’ inaugural game at the new ballpark last April, it was apparent Alvarez had been hitting the barbells — muscles ripped from his short-sleeved shirt, various media reports noted.

Peter Potter, who judged Alvarez to victory at the Knight Center, said there was no mention of Alvarez’s mayoral past in his bio, just a mention that he was the former police director. Potter initially had no idea of Alvarez’s former life.

“One of the other judges who lives in Miami pointed out to me’’ that Alvarez was the former county mayor, Potter said. Alvarez “didn’t broadcast it.”

The mayor’s bodybuilding victory was first reported Tuesday by the Miami New Times.

Michael Sansevero photographed the event. He said Alvarez forked over $75 for pictures and video.

“I was kind of surprised when I saw him,” Sansevero said. “He must always have been in good shape, but he was in real good shape.”

Alvarez, whose current employment status is unknown, could not be reached for comment.

Alvarez spent 35 years with Miami-Dade County, the first 28 in the police department, where he worked his way up to the top job.

When the former mayor left office, he was earning salary and benefits worth $325,309, county records show. His last financial disclosure put his net worth at $1.74 million.

Alvarez’s annual police pension pays him $180,216, and he received a one-time payout of $287,879 for entering an early retirement plan.

Alvarez also participated in a retirement investment plan during his seven years as mayor, during which the state matched his contributions. Numbers weren’t immediately available for that plan Tuesday.

Miami Dolphins slam Norman Braman, Marlins Park deal




















The Miami Dolphins ramped up their public campaign for a tax-funded stadium renovation this week, buying full-page ads against their top critic and trying to distance the plan from the unpopular Marlins deal.

The team bought an ad in Tuesday’s Miami Herald and El Nuevo Herald knocking auto magnate Norman Braman’s criticism of the Sun Life Stadium deal, which would have Florida and Miami-Dade split the costs with owner Stephen Ross for a $400 million renovation. The Dolphins would pay at least $201 million, with taxpayers using state funds and a higher Miami-Dade hotel tax to pay $199 million.

In a fact sheet sent to media Tuesday morning, the Dolphins listed ways their deal differs from the 2009 Marlins deal. First: Ross, a billionaire real estate developer, would use private dollars to fund at least 51 percent of the Sun Life effort, compared to less than 25 percent from Marlins owner Jeff Loria. Second, Sun Life helps the economy more than the Marlins park does.





“Just because the Marlins did a bad deal doesn’t mean we should oppose a good deal where at least a majority of the cost is paid from private sources and more than 4,000 local jobs are created during construction alone,” the fact sheet states. And while the Dolphins’ Miami Gardens stadium has hosted two Super Bowls since 2007 and is in the running for the 2016 game, “Marlins Stadium does not generate the ability to attract world-class sports events -- other than a World Series from time to time depending on the success of the team.”

NFL teams play eight home games a year if they don’t make the playoffs, while baseball teams have 81.

Miami and Miami-Dade built the Marlins a $640 million stadium at the site of the Dolphins’ old home at the Orange Bowl in Little Havana. The Marlins contributed about $120 million and agreed to pay between $2.5 million and $4.9 million a year for 35 years to pay back $35 million of debt the county borrowed for the stadium. As a publicly owned stadium, the Marlins ballpark pays no property taxes. Most of the public money came from Miami-Dade hotel taxes, along with $50 million of debt tied to the county’s general fund.

Sun Life is privately owned and pays $3 million a year in property taxes to Miami-Dade. It currently receives $2 million a year from Florida’ s stadium program, a subsidy tied to converting the football venue to baseball in the 1990s when the Marlins played there. The Dolphins also paid for a second full-page ad with quotes from leading hoteliers in Miami-Dade endorsing the stadium plan. Among them: Donald Trump, whose company recently purchased the Doral golf resort. “Steve Ross’ commitment to modernize Sun Life Stadium -- while covering most of the construction costs -- is the right thing for Miami-Dade,’’ the ad quotes Trump as saying.

Also on Tuesday, Ross and team CEO Mike Dee sent a letter to Miami-Dade Mayor Carlos Gimenez and county commissioners requesting negotiations over the stadium deal. The letter said the deal Ross unveiled last week is a “baseline for debate” and asked for talks. The letter also urged the commission to adopt a resolution proposed by Commissioner Barbara Jordan endorsing the state bill that would allow taxes for Sun Life. The resolution is on the agenda for Wednesday’s commission meeting.

‘Atari’ Is in Trouble Again






Atari is declaring bankruptcy — twice. Both the U.S. video game company and its French parent have done so, the latest twist for the company which largely invented the video game industry and remains synonymous with it, despite having seen its glory days end by the mid-1980s.


But wait. Even though the Atari name celebrated its fortieth anniversary last year, it’s a mistake to talk about Atari as if it’s a corporate entity which has been around for four decades. (The Los Angeles Times’ Ben Fritz, for instance, refers to it as an “iconic but long-troubled video game maker.”) Instead, it’s a famous name which has drifted from owner to owner. It keeps being applied to different businesses, and yes, for all its fame, it does seem to be a bit of a jinx.






Here’s a quick rundown of what “Atari” has meant at different times (thanks, Wikipedia, for refreshing my memory):


1972-1976: It’s an up-and-coming, innovative startup cofounded by Nolan Bushnell and Ted Dabney.


1976-1984: It’s part of Warner Communications (which, years later, merged with Time Inc. to form Time Warner, overlord of this website). It’s a massively successful maker of video games and consoles, but then it crashes, along with the rest of the industry.


1984-1996: Atari morphs into a semi-successful maker of PCs when it’s acquired by Tramel Technology, a company started by Jack Tramiel, the ousted founder of Commodore.


1996-1998: Tramiel runs Atari into the ground. After merging with hard-disk maker JTS, the company and brand are largely dormant.


1998-2000: Atari resurfaces under the ownership of  toy kingpin Hasbro as a line of games published under the Atari Interactive name.


2000-present: It becomes a corporate entity controlled by French game publisher Infogrames, which increasingly emphasizes the Atari moniker over its own and takes over completely in 2008. In recent years, it’s focused on digital downloads, mobile games and licensing of its familiar brand and logo.


The above chronology doesn’t account for Atari’s original business: arcade games. As far as I can tell, the arcade arm was owned at different times by Warner Communications/Time Warner (twice!), Pac-Man purveyor Namco and arcade icon Midway, among other companies. But use of the Atari brand on arcade hardware petered out in 2001.


Basically, Atari has never been one well-defined thing for more than twelve years, max, at a time. That the name has survived at all is a testament to its power and appeal. And even though the current Atari has fallen on hard times, I’ll bet that the brand survives for at least a few more decades, in one form or another. Several forms, probably.

Sheryl Crow on Lance Armstrong Doping Confession to Oprah Winfrey

Sheryl Crow (who will be advising Blake Shelton on The Voice this season) opened up to Nancy O'Dell on the set of the singing competition over the weekend, commenting on Lance Armstrong's doping confession.

"I think that honesty is always the best bet and that the truth will set you free," said Crow, who caught "bits and pieces" of her ex-fiance's interview with Oprah Winfrey. "To carry around a weight like that would be devastating in the long run."

Armstrong, 41, and Crow, 50, began dating in 2003 -- the same year that Armstrong divorced his wife of five years, Kristin -- and split in 2006.

Last year, a report from the U.S. Anti-Doping Agency led to Armstrong's downfall. The shamed cyclist was stripped of his seven Tour de France titles and, until now, vehemently maintained his innocence.

Thank you, Honorable Justice Ingram for your role during this trial (and beyond.) A very special thank you to Assistant DA Kevin O’Donnell for your endless hard work and sleepless nights throughout the trial in order to see justice served.

Standing here, I think back to those years throughout my ordeal when I suffered great psychological damage and fell into severe depression. I clearly remember how I would look in the mirror and see a person I didn’t recognize. I saw a girl who didn’t want to live in her own skin. A girl whose innocence was shattered at the age of 12.




A girl who couldn’t look at her own reflection without feeling repulsed knowing what abuse that tortured person was continuously experiencing. A girl who couldn’t sleep at night because the horrifying images of the recent gruesome invasions which had been done to her body kept replaying in her head. A girl who numbed her feelings and froze her emotions every minute of the day just to stay sane. A girl who was forced to lose any respect for herself. A girl who lost the right to say NO, to an abuser who used and abused her repeatedly for years that seemed like forever and ever. A sad girl who so badly wished she could have lived a normal young teenage life but instead was stuck being victimized by a 50 year old man who forced her to experience and perform sickening acts for his sick sense of pleasure again and again.

I saw a girl who didn’t have a reason to live.

I would cover up the burn marks inflicted on the body he used to serve his sadistic pleasures. Every time I would look at it, I would get flashbacks and feel my body burning all over again. I would cry until my tears ran dry.

But now, with the help and support of so many officials, family members, friends, supporters, and of my dear husband, I finally stood up and spoke out.

I gathered all my inner strength and courage to go through this battle. A battle of justice, to right in some small way the terrible wrong, to prevent further evil, to protect the innocent, and most of all, to heal. It continues to be a very rough battle that brought me, my parents, and family great humiliation and intimidation, aggravation and rejection, strain and loss of business, each too great to describe.

However, this same battle was one of righteousness. A battle that was the voice of other silent Weberman victims coming forward to bring this monstrous perpetrator to justice. Unfortunately, the others could not or would not publicly testify. Many were too scared to face the opposition and repercussions from the community while others had already passed the statute of limitations — but we were all one voice as they were with me in spirit.

CrimeWatch: Son asks mom why no one saw Sandy Hook coming




















Today is the second anniversary of the death of Miami-Dade police officers Roger Castillo and Amanda Haworth, who were killed while serving an arrest warrant. I extend our thoughts and prayers to their families, theses officers died protecting this community and we should all be extremely grateful for their sacrifice.

Words will never easy the pain and suffering for the family, but may they know that this community holds them in their heart. I know I do. Rest in peace, officers Castillo and Haworth. You will never be forgotten.

During the last couple of weeks, I have received several emails from parents regarding the Sandy Hook Elementary shooting. Many emails were filled with anger and helplessness along with fear of the unknown. There was one email that I want to share with you because it relates to our Youth Crime Watch program in the schools. This mother wanted me to share so that parents understand that our children are very astute and understanding of serious situations.





Dear Carmen,

I want to share with you something that happened with my son after the Sandy Hook Elementary shooting.

My son attends an elementary in the north area of the county I don’t want to give the name. But my son is a member of your Youth Crime Watch program, this is his second year being involved, and he is in the sixth grade.

Needless to say he was very upset because he couldn’t understand how someone could kill so many kids, but what really bothered him was why no one had known about [shooter Adam Lanza]. I tried to explain to him some of the facts of the incident. His answer: “Mom, at our Youth Crime Watch club we learn from McGruff the do’s and don’ts when there is danger, especially reporting to teachers if we see something that is not right. Someone must have known something.”

My son is not and was not scared to going back to school, because he knows that his club members have vowed to always keep their ears to the “ground” and speak when something is not right. At the same time he spoke about the “school bus shooting,” another tragic incident. He stated that lots of kids knew this kid had a gun, yet no one told a teach or police officer. My son wants to grow up to be a police officer, and that makes me fearful since it’s such a dangerous job, but I will support his efforts as he grows up.

My son has learned much from your Youth Crime Watch program, and I am very grate full for the efforts you and your staff have produced in his school. I truly feel that your efforts, and those of the school counselors that handle this program will help in keeping our kids safe and I pray that they never see themselves in this situation, but I am confident that his small group of students are in the forefront of helping to make his school safe. I truly hope that our superintendent and School Board members recognize the work you all do for our children.

Samsung decides to kick RIM when it’s down by bashing BlackBerry in new ad [video]






Samsung (005930) is well known for its clever ads mocking Apple (AAPL) and its fans, but the company has decided to pick on a less powerful target in its newest ad that takes swipes RIM (RIMM) and its BlackBerry smartphones. The ad revolves around an office that is implementing its own bring-your-own-device policy and is meant to show that both the Galaxy S III and the Galaxy Note II are ideal business phones that can enable greater creativity. While most workers in the ad happily switch to Samsung smartphones after the BYOD policy is put in place, one of them insists on clinging to his BlackBerry, which prompts one of his coworkers to ask, “Are you finally going to retire that thing?” The full video is posted below.

Cops looking to ID gal accused of snatching handbag from Dream Hotel








A pretty blonde club-goer is accused of swiping a handbag from the swanky Dream Hotel in December then used it at a nearby bodega – and now police are asking the public to help identify her.

The incident occurred at the hotel’s Electric Room nightclub on West 16 Street between Eighth and Ninth Avenues around 3:30 a.m. on December 28, cops said.

The purse contained the victim’s credit card, cops said. The perp was caught on camera walking down a hallway to the hotel’s public bathrooms, police said.

It’s unknown what she used the card for at the deli, cops said.

Few blacks appoint to judgeships by Gov. Rick Scott




















Gov. Rick Scott is on pace to appoint fewer African-Americans to judgeships in Florida than either of his two

predecessors, Charlie Crist and Jeb Bush.

In his two years as governor, Scott has appointed 91 judges. Six are black, including the reappointments of three judges who handle only





cases involving benefits to injured workers.

Scott has appointed two African-Americans to the circuit court bench, both in Miami-Dade County, and has appointed a black county judge in Jacksonville.

In a state as diverse as Florida, racial and ethnic diversity in the court system has been a concern for decades, and it erupted anew last

week in the state Capitol.

At a roundtable meeting with black legislators, Scott defended his appointments in the face of criticism that his record is “appalling.”

“There’s a sentiment in the black legal community that we need not apply because we don’t think like you,” Rep. Darryl Rouson, D-St.

Petersburg, told the governor.

Unmoved, Scott said he’s limited in his choices by the lists of finalists he gets from local judicial nominating commissions or JNCs,

which screen judicial candidates and can recommend up to six candidates for each court vacancy.

Scott said he’s trying to improve diversity on the judicial panels but also emphasized that he won’t appoint activist judges.

“If an applicant — I don’t care who they are — believes in judicial activism, I’m not going to appoint them,” Scott told the black legislators’ group.

Former Gov. Jeb Bush also opposed activist judges and sought “interpreters of law, not creators,” as he said in 2004. But one of

every 10 judges Bush appointed was African-American.

Scott’s immediate predecessor, Crist, who served one four-year term, appointed 15 black judges, five in the first half and 10 in the second

including James Perry, a justice of the Florida Supreme Court.

Statistically, 6.6 percent of Scott’s judicial choices are black at the midway point of his term, compared to 8.3 percent for the term of

Crist, governor from 2007-2011, and 10 percent for Bush, who served the previous eight years. African-Americans make up 16.5 percent of Florida’s population according to the Census.

Scott has appointed proportionally more women and Hispanics to judgeships than Crist, and about the same as Bush.

For four decades, Florida judicial vacancies have been filled through a system known as merit retention, which replaced a system in which

governors could pick the candidates of their choice. It was designed to lessen political influence and improve the caliber of legal talent

on the bench.

Scott’s new chief legal adviser, Pete Antonacci, a veteran of four decades in state legal and political circles, said nominating panels

continue to be controlled by local political forces and bar groups and that Scott is at “the end of a pipeline” dominated by local politics.

“If people are believing that the system is a politics-pure zone, they’re wrong,” Antonacci said. “It all occurs inside the bubble of

the bar.”

By law, Scott has a free hand in making five of nine appointments to each of 26 judicial nominating commissions. He must pick the other

four from lists of three names for each vacancy, submitted by the Florida Bar, which Scott can reject without explanation.

Just last week, Scott asked the Florida Bar for new names for JNC vacancies in the Pinellas-Pasco circuit and in the Gainesville area.

Scott has appointed more judges in Miami-Dade than in any other county. Of Scott’s 21 selections in the state’s largest county, 13 are white (seven women and six men), six are Hispanic and two are African-American: Rodney Smith and Eric Hendon. In four instances in Miami-Dade, Scott chose white judges to replace Hispanics.

All three of Scott’s judicial appointments in Hillsborough are white; two men and a woman.

“We have a dynamic pool of African-American attorneys in Hillsborough County,” said Tampa lawyer Cory Person, president of the George Edgecomb Bar Association, a black lawyers’ group. “Gov. Scott’s record does not suggest a real effort to attract and appoint minority candidates.”

Scott has filled six of nine seats on Hillsborough’s judicial nominating panel; none is African-American. All seven Scott appointees

to judicial panels in Miami-Dade and Broward are white or Hispanic, according to the governor’s office.

To date, Scott has not appointed any judges in the Sixth Judicial Circuit for Pinellas and Pasco counties.

Investors await word from Apple




















No company today elicits such devotion and dedication among its customers and shareholders like Apple. The fervor felt by Apple fans for its products, its leaders and its business underscore the company’s technological eco-centric strategy. While that loyalty has made for rich rewards over the long term, it will mean very little to a myopic stock market when Apple reports its latest financial results Wednesday.

When a company so dominates a business like Apple does, it is subject to plenty of rumors, especially when that company, like Apple, is disciplined to not respond to speculation. There have been a series of anonymous and Wall Street analyst worries floated in the past quarter centered on the iPhone 5. First were concerns Apple couldn’t get enough supplies to build the phones fast enough. Then there were hints Apple cut its supply orders, suggesting slower sales.

Apple optimists have been quick to defend the company even as its stock has fallen from $700 to around $500 per share since September. The stock drop has come even as Apple probably sold a record number of iPhones and iPads during the holiday quarter.





No doubt Apple will trumpet its financial prowess on Wednesday. And it should. After all it generates more than $500 million dollars a day. But the short-sighted stock market has been conditioned to expect big numbers. Therein is the challenge for Apple: incubating such devotion without inflating expectations.
